Medical malpractice is professional negligence by act or omission by a health care provider in which the treatment provided falls below the accepted standard of practice in the medical community and causes injury or death to the patient, with most cases involving medical error.

These medical malpractice cases would include a variety of matters, including birth defects or brain damage suffered during the birth process resulting in birth asphyxia.  The damages you suffer come in many forms – including pain and suffering, costs of medical treatment later to rectify the negligence and in some cases, loss of income – either for time off work, or because you can no longer work or can no longer work in the same sort of field that you did previously.
